Two Solutions and will to perform…options before Indian Democracy

The institutes of the state that guard the democracy are the legislature, the executive and the judiciary with their separated powers accorded by the constitution of India.

The legislature with most of its working time gone into adjournments and walk-outs, the political parties not allowing the parliament to perform its functions deliberately restricting its procedures, is now a common ‘live’ telecast.

Why don’t we set out a rule of procedure of the legislatures that whenever the normal proceedings are either not allowed to happen or adjourned, the lost time has to be compensated by working extra hours and finishing the pending legislations ??!! This would ensure that the grievances are heard if they are genuine and the time is allocated for the generic work items too. It also discourages  unwanted and political walkouts as the politicians have to think about coming and making up for the lost time ! They rather stay quiet !

This is very much possible in the framework of our constitution, I hope a leader emerges and executes.

The executive and the legislature are almost taken for granted that they never can be made better, and the notion of “It happens only in India” is applied to their very cases. But the last of the trio, judiciary is generally an exception and the perception is not so much bad as the other two.

Even with the 30 million pending cases before all the courts of India, people still have enough faith in the judgements and the institute’s  value that at least justice will be honored in one’s lifetime. But the incidents and other happenings during the last three to four years are in a direction where the sanctum of the institute is itself under severe questioning.

The dealing of Bhopal Gas tragedy Case is a widely known issue. Other cases like, an instance in which the Supreme Court of India denied to give information whether the judges are filing their asset(s) details to the Chief Justice of India is a barely open case of unaccountability and lack of transparency.

Many of the corruption charges against the sitting judges of the Supreme Court and the High Courts are neither investigated nor the judges suspended. The power to order the investigation lies with the judiciary (wow!) and they are not bothered !!! They take up their own cases !!! Even when the evidence is widely accepted as correct , at least an investigation team should be appointed. No luck in a democracy.

The Supreme Court also is very much strict and particular in making the judges appointment !! Let me give an example. Suppose you went into a class of 100 students and the president of India comes to you and asks to give him 10 candidates out of these so that he can appoint them as Judges for Supreme Court. All the 100 students meet the requirements of being a supreme court judge. So what would I do ? The easiest is , to pick up 10 randomly or if I knew any of them just by name of if some girl is looking awesome, I may choose to ‘impress’ her.

No one is allowed to apply for any of the post, no one is considered for any recruitment process nothing.
If we can set a simple process of picking 10 from 100 qualified students, the quality of judges would have been much much better.

I tried to give two possible solutions to some of the problems that were being faced. There are more solutions to more and more problems. All we need is a will to execute.
